FRESNO, Calif. – A Fresno high school teacher who was shot during a robbery at his school is suing the district and numerous staff who allegedly played a contributing role in the incident.

Edison High School teacher Steven Guerrero filed a lawsuit against the Fresno Unified School District this week after several armed teens broke into the school, bludgeoned him with a 25 pound weight, and shot him twice as he fought for his life, The Fresno Bee reports.

The teens had come to the school Dec. 19, 2013 to steal computers when they encountered Guerrero as he was preparing to leave for the night around 7 p.m. Guerrero’s lawsuit alleges that several contributing factors at the school are to blame for the break-in including a janitor who left a door unlocked, a lack of staff training, and inadequate outdoor lighting, according to the news site.

The lawsuit also alleges that comments district superintendent Michael Hanson made to Guerrero’s wife Isabelle about the teacher being a “knucklehead” for fighting back against the intruders left her “suffering mortification and severe emotional distress.”

The superintendent allegedly told Isabelle that he should have just played dead. Now she’s anxious, depressed and needs counseling, the Bee reports.

“The four teens accused of attacking Guerrero — Nicholas Cruz Padilla, Jaime Gonzalez, Gilberto Ramos and Jose Alfredo Zinzun Jr. — appeared in Fresno County Superior Court on Tuesday for a status hearing on their criminal case. Because of the seriousness of the charges, they are being tried as adults. Their next hearing in Jan. 27. They remain in custody at the Juvenile Justice Center south of Fresno,” according to the Bee.

“Steven A. Smith, a Fresno lawyer representing the Guerreros, said they are in an ‘almost perpetual state of anxiety’ because the defendants know where the family lives and the Guerreros are being pressed by the District Attorney’s Office to be witnesses in the criminal case.”

Hanson spoke to the Bee through district spokeswoman Micheline Golden, who said “All of the actions that he took that evening were in support of that teacher and his family.”

He had no comment on the lawsuit.

Smith told the Bee his client has sought help from the district and victims services to move but hasn’t gotten anywhere. He still teaches part time at Edison and other schools as an athletic trainer and has considered quitting, but has no other means to support his family, Smith said.

“This is his way of earning a living,” Smith said.

There’s a lot of defendants listed in the lawsuit, including the district, Hanson, Edison Principal Lindsay Sanders, Vice Principal Kevin Evangelinos, custodian Pang Yang, employees Louis Villanueva and Dez Banger and others.

“The lawsuit alleges Yang failed to lock the door to the trainer’s room during cleaning and that Villanueva and Banger negligently failed to repair and maintain outdoor lighting on the Edison campus. Hanson, Sanders, Evangelinos and others were negligent in failing to supervise the employees and in failing to train them in safe school practices, the lawsuit says,” according to the Bee.
