FARMINGTON, Utah – A Utah teacher awaiting trial on several felony sex charges for allegedly inappropriate sexual relationships with her students faces a new set of similar charges over another alleged encounter while on bail.

Former Davis High School teacher Brianne Land Altice, 35, was charged last Tuesday with three counts of unlawful sexual activity with a minor and one count of dealing harmful materials to a minor, all third-degree felonies, for allegedly engaging in sexual intercourse with a 17-year-old student between Nov. 1 2013 and Aug. 25, 2014, the Desert News reports.

She also texted the teen a picture of her bare breasts on June 7, 2014, police allege.

Altice was out on bail at the time on charges of rape, forcible sodomy, forcible sexual abuse, and unlawful sexual activity with a minor for two other inappropriate relationships with students. Altice is accused of having sex with another 17-year-old boy between April 1 and June 30, 2013, as well as sex with a 16-year-old student between January and June of the same year.

“The new charges bring her to a total of three alleged victims, five counts of rape, a first-degree felony; two counts of forcible sodomy, a first-degree felony; three counts of forcible sexual abuse, a second-degree felony; three counts of unlawful sexual activity with a minor, a third-degree felony; and one count of dealing in harmful materials to a minor, a third-degree felony,” according to the news site.

Prosecutors initially sought to amend their original charges against Altice, but later filed a separate case with the new charges because Altice was not an educator at the time, unlike the other charges, People.com reports.

“Altice was initially arrested in October 2013, and criminal charges were filed against her in December 2013 after a 16-year-old boy told police he had several sexual encounters with Altice between January and September,” The Salt Lake Tribune reports.

“In October 2014, a second teen testified at a preliminary hearing that he was 17 years old when a relationship with Altice took place between April and June of last year – a relationship that began with kissing between class periods and eventually led to intercourse.” That alleged victim described Altice as a “teacher with benefits,” according to People.

Altice is scheduled for a preliminary hearing this week to review evidence that she had sexual contact with a third victim, another 17-year-old boy, between August 2013 and September 2013. Prosecutors allege the newest charges stem for sex acts Altice allegedly committed with one of her three original victims while on bail, the Tribune reports.

Altice faces up to life in prison if convicted on all counts. She was fired from the school district in February, People reports.

Altice’s attorney, Edward Brass, has filed a motion to separate the trials for the three alleged victims, “arguing that the alleged acts were ‘not part of a common scheme or plan,’” according to the Tribune.

In another motion, filed before the most recent charges, Brass alleges the alleged sexual encounters while on bail “did not happen at all,” the news site reports.

Police contend Altice admitted to engaging in sex with the alleged 16-year-old victim when interviewed last October, but Brass wants her alleged confession suppressed because he said it was made under duress, People reports.
