LOS ANGELES – Parents of a former Los Angeles Unified School District student and the family’s attorneys are calling out the district’s attempt to discredit the girl, who was sexually assaulted in an elementary school bathroom in 2012.

The attorneys – Louis Carrillo and Michael Carrillo – held a press conference Monday to highlight the district’s response to a lawsuit filed by the family against the district over the assault, which occurred at 95th Street Elementary when the girl was 12 years old, KABC reports.

Standing in front of LAUSD headquarters, the lawyers said a recently obtained report produced by a psychiatrist hired by the district to examine the child in 2015 and 2016 concluded the sexual assault never happened, and alleged the girl was simply seeking attention by reporting the crime.

“I believe that they embarked on a dirty campaign to trash the child, to intimidate the family to drop the lawsuit,” Luis Carrillo said.

“The psychiatrist says that the child has made it all up,” he said. “That’s their defense.”

In the spring of 2012, the then fifth-grader at 95th Street Elementary told officials a strange man sexually assaulted her in a school bathroom, though she waited two weeks to report the incident to her mother, who relayed the information to the Los Angeles County Sheriff’s Department. Detectives released a composite sketch of a suspect, but school security cameras were deactivated and there was no other physical evidence, NBC Los Angeles reports.

The suspect was described as a white or Hispanic man between 20- to 30-years-old and about 5 feet 7 inches to 5 feet 9 inches tall. He had shaggy hair, facial acne and wore a gray sweatshirt with black pants, the girl told police.

Carrillo says the school district hired a psychiatrist to question the girl. The doctor issued an opinion that the child made up the story in a “pathological attention seeking” effort, even though another doctor with the LA County Department of Mental Health had diagnosed the child with post-traumatic stress disorder.

The girl’s mother said she has no doubt her daughter was attacked, and she expressed outrage that district officials have worked to discredit her story.

“My peace of mind is gone. It’s completely gone. I don’t trust anyone anymore,” said the mother, who declined to be identified. “She gets up at 2, sometimes 3 in the morning. She’ll come (and say): ‘Mom, I can’t sleep. Mom, I’m scared.’”

LAUSD officials issued a statement in response to the press conference.

“As we do in every case, we have treated this student with respect, and provided highly trained and experienced professionals who are specialists in their field,” the statement read.

“We understand how difficult these situations can be and, as we have said all along, we remain open to reaching a reasonable settlement with the student.”

The girl’s mother told the media the family has since moved to a different school district.

The attorneys are calling on the California Attorney’s General Office to launch a full investigation into the district’s conduct in the case.
