MADISON, Wis. – More facts are coming out related to the Wisconsin “John Doe” investigation and they reveal the depths to which a so-called “accountability” agency was attempting to go to regulate free speech.

The Government Accountability Board – the agency allegedly dedicated to ensuring campaign laws are followed – is under fire because it’s accused of not following the law itself. Worse, it’s accused to engaging in a partisan witch hunt against conservatives.

Watchdog.org reports:

Agents for the embattled state Government Accountability Board continued a zealous campaign finance investigation into dozens of conservative groups even after judges who preside over the board voted to shut it down, according to a previously sealed brief made public Friday.

The documents, from an updated complaint filed by conservative plaintiffs in a case against the GAB, appear to support claims that the campaign finance, ethics and election law regulator is a rogue agency. They also show that the GAB considered using the state’s John Doe law to investigate key state conservatives and even national figures, including Fox News’ Sean Hannity and WTMJ Milwaukee host Charlie Sykes.

The board had “played a substantial role in preparing and drafting” several search warrants on prominent conservative activists, according to court documents.

“What we have uncovered so far shows the Government Accountability Board, or at least its staff, being anything but ‘accountable,’” says Eddie Greim, attorney for plaintiffs in a lawsuit against the GAB, according to the news outlet.

“For example, the public has learned for the first time, over GAB’s objections, that GAB set up a secret system of Gmail accounts for its staffers and the prosecutors who ran the John Doe.  We also know that GAB hoped its ‘illegal coordination’ theory could even extend to allow it to subpoena media figures like Charlie Sykes and Sean Hannity.”

The “John Doe” investigation was launched in August 2012 and being led by Milwaukee County District Attorney John Chisholm, a Democrat, with the belief that conservative groups were illegally coordinating.

EAGnews previously reported a source within Chisholm’s office claimed the DA launched the witch hunt after Scott Walker’s collective bargaining reform proposal made Chisholm’s wife cry.

Writing in the Milwaukee Journal-Sentinel, Christian Schneider says there’s ample reason to “blow up” the GAB. He writes:

According to the audit bureau, the board has had significant problems adhering to state law, this, despite the fact that the board is charged with administrating state election law. The audit found that the GAB hadn’t conducted post-election monitoring for 16 elections held from February 2010 through April 2014 to determine whether felons had voted.

GAB staff argued that the information on felons was unreliable, so the reviews were difficult to conduct. Yet, somehow, all 16 election reviews were completed between April and June of 2014.

In fact, the audit tells a tale of a rogue agency run by its staff with little board oversight. In early 2008, the board approved a schedule providing penalties for various election law infractions. But it seems the staff just took that plan and threw it out the window, imposing capricious penalties however staffers saw fit. Between 2010 and 2013, staff didn’t sanction 655 of the 674 instances in which candidates turned in campaign finance reports late, and, of the 19 that were penalized, none were according to the schedule approved by the board.

It’s interesting an agency that has such credibility issues would seek to target such a high profile news personality as Sean Hannity.
