MAPLEWOOD, N.J. – A New Jersey high school teacher who allegedly engaged in sex acts with six male teens was indicted on dozens of criminal charges of sexual assault and endangering the welfare of a child.

An attorney for Columbia High School language arts teacher Nicole DuFault, meanwhile, plans to argue that a brain injury played into the married mother of two’s alleged sexual trysts with her 14- and 15-year-old students, the New York Post reports.

“I feel confident in stating and firmly believe in my heart that there is only one victim, not six, and that victim is Nicole DuFault,” lawyer Timothy Smith told the news site.

“I believe that Ms. DuFault’s brain trauma and surgery, which rendered her particularly vulnerable to the students’ mentality, will factor significantly at the trial,” he said.

DuFault, 35, is expected back in court March 6 after she was indicted by a grand jury on a total of 40 charges for aggravated sexual assault and child endangerment, according to court documents made public Tuesday, CBS New York reports.

Police allege the veteran teacher performed sex acts with six different male students on numerous occasions in 2013 and 2014, including rendezvous on school property and in her car, according to the news site.

Essex County prosecutors presented evidence in the case including a video of the teacher performing oral sex on a student with another nearby. Investigators allegedly matched the clothing she was wearing in the video to items seized in a search of her home last year, the Post reports.

Authorities also secured statements from five victims about sexual interactions with DuFault, as well as statements from others who “witnessed her in sexual acts …,” according to the Daily Mail.

The alleged sex acts with students was part of a trend of unprofessional behavior that also included “inappropriate sexual conversations in the classroom,” and lying on her resume about her work experience, according to the news site.

DuFault was arrested last September, and her two young children – boys aged 2 and 4 – were taken into state custody at the time. Her husband also walked out on her, according to media reports.

DuFault was fired from her job, as well.

Columbia High School Principal Elizabeth Aaron issued a statement to the school community, but refused to discuss the case with CBS New York.

“The CHS administrative team, guidance counselors, student assistance counselors, school social workers and teachers are actively supporting students =and staff impacted by events,” the statement read.

“If your child is showing signs of stress in reactions to the events or the investigation, please reach out to his or her guidance counselor or a member of the administrative team.”

DuFault is current free on a $500,000 bail.
