SAN SABA, Texas – Parents of a Texas high schooler claim a school employee poisoned their son’s lunch after an altercation with the child’s mother.

Serena and Gary Spivey filed a lawsuit against Mullin Independent School District this week after they claim their son became seriously sick last Friday after eating his school lunch, KXXV reports.

Serena Spivey said the incident was the latest in a series of altercations with the school’s lunch lady, Ms. Day, who had repeatedly threatened to poison her son’s food.

The ongoing dispute started when the lunch lady allegedly bullied Spivey’s son and she confronted her about it just over a week ago at a school volleyball game.

“After I had started the conversation she had punched me and then her daughter from the side punched me and then her sister from behind kicked me while holding a baby,” Spivey told the news site. “I don’t think it’s right for the lady that punched me to still be working up here around kids.”

Threats to poison her son’s food followed the fight, Spivey said, and on Friday her son came home sick from school.

“My son comes up here and eats and 30 to 45 minutes later, he can’t hardly walk, throwing up, diarrhea,” Gary Spivey said.

District officials told the news site that Ms. Day has worked for the school system for about nine years and was in good standing. She was not fired after the fight with Spivey, but was ordered to stay away from the family.

“Mullin ISD’s superintendent said they were made aware of the allegation concerning the staff member possibly poisoning a student’s food,” KXXV reports. “The district is currently investigating that incident.”

District officials did not detail whether the staff member is continuing to work during the investigation. The Spiveys want district Day fired.

The local kerfuffle is sparking heated debate on Facebook.

“As a parent of a child at this school who SAW what went down during that fight and who sees what happens at the school, I have no problem saying that this story is nothing more than a retaliatory act. Mrs. Spivey started that fight. The reason Mrs. Day was not fired was because she DEFENDED herself only. Check out the police reports and you’ll see that,” Michelle Florence wrote.

“I have seen food service at school and staff bully kids,” Stephanie Penny posted. “Plus they have come after me too.”

“So Sad. I cannot understand why people try to hurt others the way they do. They try to ruin people’s lives. Lori Day would never hurt a child,” Lena Day wrote.

“Wow the threats to poison student food aren’t taken seriously enough to fire this lady alone? What a shame,” Sara Starr posted.
