NEW YORK – A student at Bronx Prep Charter School reported to school and law enforcement officials that she was raped by another student in an empty classroom Tuesday.

The female student, 15, was waiting in an empty classroom for a tutoring session around 10:30 a.m. Tuesday, but the teacher never showed. Instead, a 19-year-old male student she had previously engaged in sexual acts with allegedly showed up, drug her by the wrist to a corner of the classroom and forced her to have sex, the New York Post reports.

The girl told police she had previously performed oral sex on her alleged attacker in classrooms three to five times prior, but repeatedly said “no” and tried to escape during the incident. He reported the alleged sexual assault to a friend around 1 p.m., before contacting school officials a short time later, according to the news site.

“The police were notified and Kevin Simpson, a 19-year-old senior, was arrested on rape charges …,” the Post reports.

“Simpson was arrested Jan. 9 for allegedly assaulting a court officer, riot, obstructing governmental administration and disorderly conduct, sources said. He was also arrested in August for weapons possession and had an active arrest warrant for failure to appear on an open container charge, law enforcement sources said.”

Simpson was reportedly scheduled to be arraigned yesterday on felony charges of rape in the first degree, sexual abuse with forced compulsion and committing a criminal sex act, the Bronx district attorney’s office told the New York Daily News.

According to the Daily News:

School personnel were working closely with the victim’s family, according to a spokeswoman for Democracy Prep Public Schools, which took over the school in July after years of academic decline.

“We are in close contact with her family and giving them all the support and resources at our disposal,” spokeswoman Alice Maggin said in a statement. “The safety of our students is our paramount concern.”

Simpson’s family declined to comment on the allegations when contacted by the Daily News. Maggin said school officials are informing parents and students of the incident today.

The alleged rape is the second in New York City schools in as many months.

“In October, a 12-year-old girl and 13-year-old girl accused two boys, ages 13 of 14, of raping them in the auditorium of Urban Science Academy on Teller Ave. in Claremont, police said,” according to the Daily News.

“The alleged attackers were arrested in the following days. The older teen was charged as a juvenile with the first-degree rape and the younger boy faces a third-degree rape count.”
