ROCHESTER, N.Y. – The family of a boy who was molested by his elementary gym teacher during the 2006-07 school year is suing the Rochester school district for its alleged failure to protect the boy.

Teacher Matthew LoMaglio was convicted earlier this year of sexually assaulting the boy and sentenced to four years in prison.

But the chapter is not closed for the victim and his family. They believe the school district – particularly former Assistant Principal Susan Hasenauer-Curtis – could and should have done more to protect the student and prevent the abuse.

The victim’s mother first became concerned in 2006 when her son, then only eight-years-old, started asking to be allowed to skip gym class, according to the news report. He also started wetting the bed and telling his mother that he had dreams of being raped by the gym teacher.

At that point the victim never made any specific allegations against LoMaglio.

The mother made an appointment with Hasenauer-Curtis, and was surprised to find LoMaglio present at the meeting. She requested that her son be taken out of the gym class, but was denied, the report said.

“I pleaded with her. I begged her. She told me no,” the mother said.

In 2012 the victim wrote a letter to his brother in prison, acknowledging the molestation. His mother found the note and contacted police.

Many people in the community were angered to learn that some of LoMaglio’s colleagues working in the school district refused to cooperate with police and prosecutors investigating the incidents.

The statute of limitations for filing a lawsuit against the school district has expired, but the victim’s attorney has petitioned the court to allow a late filing, the news report said.
