CLEVELAND – A special education student in the Cleveland school district recorded his teachers obnoxious, profanity-laced rant about his academic future, and reported the incident to school officials.

But instead of apologizing for the teacher’s foul-mouthed verbal abuse, district officials opted instead to threaten the student and his attorney with litigation if they exposed the teacher’s misconduct, Fox 8 Cleveland reports.

The 17-year-old learning disabled student was in the hallway at Jane Addams High School studying while two teachers discussed his academic future in a classroom. The conversation was so loud, the student and his classmate in the hallway couldn’t help but overhear, so he recorded the conversation with his cell phone.

According to that recording, obtained from the family by Fox 8, teacher Debra White is heard saying:

“You are not graduating yo momma, yo mamma has disservice you.”

“To walk these damn halls to get a sue do diploma so she can feel good about her f—- dumb a—life and she has deceived that kid.”

“You going to walk these halls for four years because your mom wants you to get a degree, a damn special ed f—– degree at that.”

The other teacher in the room with White told investigators she couldn’t remember what her colleague said, yet she miraculously recalled what allegedly occurred once she left.

The teacher said she heard a loud bang – like someone kicked or slammed White’s class door – and heard the student exclaim “You bald head b—- b—-, I just recorded you,” according to the highly redacted school incident report obtained by the news station.

The boy’s mother said he’s devastated.

“My son was hurt by what she said. Emotionally hurt. He’s terrified to go to school,” she told Fox 8.

The family hired attorney Steven Moody, who met with district officials about the teachers offending comments. But much to his surprise, they’re threatening to pursue criminal charges against the student because they allege the conversation was private.

“When a teacher is alleged to have engaged in unprofessional conduct, the matter is handled under guidelines established in the collective bargaining agreement between the District and the Cleveland Teachers Union. The process is confidential unless and until the Board of Education votes to impose discipline,” according to a district statement.

“Unfortunately, Channel 8’s report on the incident was based on a secretly tape recorded conversation that took place behind closed doors between two adults who had a reasonable expectation of privacy and who did not give permission for their conversation to be recorded. It is regrettable that Channel 8 proceeded with airing the conversation after being informed by the district that doing so could be a violation of law.”

The teachers union didn’t want to talk about the recording, and school officials wouldn’t tell Fox 8 how long an investigation will take, or whether officials will actually seek felony criminal charges against the student.

“Yes, they did threaten me and the child with felony charges, which is outrageous,” Moody told the news station.

Yesterday, officials announced they issued White a three day suspension, and blamed the light punishment on the teachers union contract.

“The nature of the suspension is based on a variety of factors including the contractual requirement of progressive discipline. Per the collective bargaining agreement the teacher has 60 days to file a grievance to appeal the suspension. The district again declines a request for an on-camera interview on this subject,” Cleveland district officials wrote to Fox 8.

Moody said the family is “not satisfied with the suspension.”

“First of all, I don’t believe this particular teacher is fit to teach,” he said. “She provides a hostile educational environment.”
